Through the representation of some of our most prominent international clients, Unilever Limited, and despite having had a trademark opposition application rejected by the Trademarks Registrars’ Office and later on appeal. HAG attorneys, persevered in 2021, by achieving to successfully oppose a second infringing trademark application for being identical to Unilever’s internationally recognized “Cornetto” trademark. The latter came following the group’s IP department’s stellar efforts in arguing that despite the ambiguity of the current IP laws and ill protection offered, the purpose of such laws is to ultimately serve the consumer public with safe protection guidelines. Therefore, despite the infringing trademark having been submitted under a different class to that of Cornetto’s, the purpose of the law remains clear, whereby the protection of the consumer public and the prevention of any confusion as to the origin of the source of goods, which might be brought by allowing for identical marks in different classes and thus further allowing for unfair competition.
